2.2  Proprietary Methodology

The analytical methodology underlying all Athlete's Arc reports — including the metric construction framework, Data Envelopment Analysis model configuration, peer group selection logic, Fit Score calculation, KPI tier assignment system, and delivery framework — is proprietary to Athlete’s Arc LLC and constitutes a trade secret. No portion of this methodology is disclosed through the delivery of a report or through any public-facing content on this Site.

2.3  Data Sources

Athlete's Arc reports incorporate publicly available statistical data sourced from NCAA program records, school athletic department publications, and publicly accessible media. Athlete's Arc claims no ownership over underlying publicly available statistical facts. All intellectual property claims apply to the analytical layer, scoring methodology, metric framework, and report presentation built upon such publicly available data.

 

Upon full payment for a Program Intelligence Report, the purchasing customer receives a limited, personal, non-exclusive, non-transferable license to use the delivered report for their own personal, non-commercial recruiting decision-making purposes.

 

Permitted uses include:

•      Reading and referencing the report for personal recruiting decisions

•      Sharing the report with immediate family members involved in the recruiting decision

•      Using the recruiter questions and data-backed lead-ins in conversations with collegiate coaching staffs

•      Retaining the report for personal records

 

Prohibited uses include:

•      Reproducing, republishing, or publicly distributing any portion of the report

•      Reselling, licensing, or commercially exploiting the report or any of its contents

•      Using the report to build, train, or inform any competing analytical product, service, or AI model

•      Reverse engineering, extracting, or attempting to reconstruct the analytical methodology from the report outputs

•      Sharing the report publicly on social media, recruiting forums, or any public platform

•      Using Athlete's Arc brand marks, product names, or report content in any commercial context without written permission

 

INFORMATIONAL PURPOSES ONLY All Athlete's Arc products and services — including Program Intelligence Reports — are provided for informational purposes only. Nothing on this Site or in any report constitutes recruiting advice, professional sports counseling, scholarship guarantees, academic advising, legal advice, financial advice, or any other form of professional guidance. Athlete's Arc is not a recruiting service and does not facilitate contact between athletes and collegiate programs.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATHLETE'S ARC PROVIDES THIS SITE AND ALL PRODUCTS AND SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

Athlete's Arc does not warrant that:

•      Reports will be free from errors or omissions in underlying publicly available data sourced from third parties

•      Fit Scores or metric ratings will predict or guarantee any specific recruiting outcome for any individual athlete

•      Program characteristics, coaching staffs, roster compositions, or other program-level data will remain accurate after a report is delivered

•      The Site will be available continuously or free from technical interruptions

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATHLETE’S ARC LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR ANY ATHLETE'S ARC PRODUCT OR SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF SCHOLARSHIP OPPORTUNITIES, RECRUITING OUTCOMES, ATHLETIC PLACEMENT, OR EDUCATIONAL OPPORTUNITIES.

IN NO EVENT SHALL ATHLETE’S ARC LLC 'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR ANY PRODUCT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Athlete's Arc makes no representations regarding the accuracy, completeness, or timeliness of third-party data. Errors or omissions in publicly available source data may affect report outputs.

The Privacy Policy is incorporated into this Legal Notice by reference.

Athlete's Arc does not sell personal information to third parties. Information submitted through the intake form is used solely for the purpose of producing the purchased report.

 

This Legal Notice and all matters arising from your use of this Site or any Athlete's Arc product are governed by the laws of the State of North Carolina, without regard to its conflict of law principles.

Any dispute not resolved through informal resolution as described in the Terms of Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina. By using this Site you consent to personal jurisdiction in those courts.

Athlete's Arc reserves the right to modify this Legal Notice at any time. Material changes will be communicated by updating the Effective Date at the top of this page. Your continued use of the Site following any modification constitutes acceptance of the revised Notice.
